General terms and conditions of the hotel industry

for weddings

The General Terms and Conditions for the Hotel Industry (AGBH 2006) and the General Terms and Conditions for the Hospitality Industry 2016 (AGBG 2016) apply.

The following "SPECIAL TERMS AND CONDITIONS FOR WEDDINGS" at the Natur- und Wellnesshotel Höflehner apply in addition to and as special provisions of the General Terms and Conditions for the Hospitality Industry 2016 (AGBG 2016). Unless expressly agreed otherwise, the bride and groom (the wedding couple) are deemed to be the organiser and invoice recipient jointly and severally. The Natur- und Wellnesshotel Höflehner is hereinafter referred to as the "Hotel".

Cancellation conditions for wedding events:

If the wedding is cancelled up to 6 months before the wedding date, a flat-rate cancellation fee of EUR 1,800 will be charged. If the wedding is cancelled up to 3 months before the wedding date, 70% of the agreed package price (menu price and all catering for the booked number of people, wedding package, all other booked services) will be charged, but at least EUR 2,000. In the event of cancellation within 1 month before the wedding date or no-show, 90% of the package price (menu price and all catering for the day for the number of people booked, wedding package, all other services booked) will be charged, with a minimum charge of EUR 2,500. The AGBH 2006 also apply as cancellation conditions for rooms for weddings. All cancellations are only accepted in writing. In any case, the organiser has no statutory right of withdrawal in accordance with § 18 para. 1 no. 10 FAGG.

Reduction:

A free reduction in the number of persons of up to 20% is free of charge up to 1 month before the event/arrival date with regard to prices or services dependent on the number of persons (e.g. menu price and drinks package, but not flowers, wedding package, etc.). A reduction of up to a further 5% of the originally agreed number of persons is free of charge with regard to prices or services dependent on the number of persons (see above) up to 1 week before the event/arrival date. If the number of persons is reduced beyond this, the organiser will be charged 50% of the reduced turnover. Irrespective of this, if the number of participants is reduced by more than 20%, the hotel is entitled to recalculate the prices based on the number of persons or to reallocate the rooms. The exact number of participants must be communicated up to 7 calendar days before the date of the event. This number is the guaranteed minimum number of participants and will be invoiced to the organiser. Should more people attend, the actual number of people present will be charged.

Prices:

The statutory VAT is included in all prices quoted. However, the hotel is entitled to make an appropriate price adjustment depending on the market and cost situation for long-term reservations, i.e. those made more than 6 months before the date of the event. [ BS1] [GH2]

Payment:

A deposit of EUR 1,800 must be paid up to 6 months before the wedding date. In the event of late payment, the hotel is entitled to cancel the event date and charge the full cancellation fee. In the event of late payment, statutory default interest will also be charged.

Premises / duration of the event:

The hotel reserves the right to select the rooms itself according to capacity and utilisation. The event rooms may not be sublet to third parties by the organiser. The event rooms are available on the day of the event 2 hours before the start of the event. The event location must be vacated by 8:00 a.m. on the day following the start of the event. All items not removed will otherwise be removed by the hotel. The organiser will be invoiced for any excessive costs incurred.

Registry office:

Music/AKM/ Noise protection:

If the performance of music is planned at the event, the organiser (= the bridal couple) must obtain any necessary registrations with AKM and entertainment tax in good time. [ BS3] [LK4] If overnight guests who are not part of the event are in the building, the music must be turned down to room volume from midnight. From 10.00 p.m. it is forbidden to play music in the outdoor area. Exceptions are weddings at the Knapplhütte, where the closing time is set to 2.00 am. Music can be played until then. If the hotel's own sound system is used, no changes may be made to the cabling. In the event of non-compliance, the corresponding costs of a specialist company for restoration shall be borne by the organiser. If the registrar wishes to play music during the wedding ceremony, a USB stick with the saved music tracks as MP3 files and the names of the songs with numbers in the desired playback sequence must be handed over to the hotel at least 3 days before the event. No other data may be stored on the USB stick.

Catering:

Food and drinks may only be brought along by prior arrangement and against payment of a fee. The organiser is fully liable for his guests in this respect. The hotel will provide a number of staff that meets the usual quality standards. The type, brand and quantity of food and beverages shall be selected at the discretion of the hotel within the usual quality standard. For food hygiene reasons, it is not permitted to take leftovers from the buffet or food. It should be noted that any cooling of a wedding cake brought along can only be carried out at the responsibility of or by the organiser at a place specified by the hotel and the hotel accepts no liability for transport damage etc. Refrigeration is only possible on the wedding day from 1 p.m. [BS5] [LK6] [GH7]

Additional services:

For all services booked by the hotel on behalf of the customer with third parties (e.g. hairdresser, flowers, cake, fireworks), any complaints in this regard must be made to the respective third-party company without recourse to the hotel and do not entitle the customer to withhold payment from the hotel.

Photos:

The hotel shall be granted an unrestricted and unlimited licence to use photographs voluntarily provided by the organiser or photographers commissioned by the organiser for its advertising purposes, provided that no persons are visible on them . This right also includes the editing of photos, in particular to make people unrecognisable. Personal rights must be respected accordingly.

Pets:

Pets are only permitted in the Knapplhütte and in the Gumpenbar during weddings if they are kept on a lead or in a muzzle.

Cleaning:

The costs for the removal of any soiling that goes beyond the usual extent are to be borne by the organiser. The scattering of non-biological substances such as confetti, plastic flowers etc. is prohibited in the entire garden area of the event location. With the exception of the banqueting tables, no decorations may be scattered anywhere inside or on any paved outdoor areas of the hotel.

Fireworks / star sprays:

The setting off of fireworks or the performance of fire shows and other pyrotechnic displays is not permitted. The use of star sprays, star throwers, sky lanterns and the like is prohibited at the event location. For the release of balloons [BS9] [GH10] or the use of drones, the organiser must comply with the relevant legal provisions and obtain any necessary permits at his own expense. The organiser shall indemnify and hold the hotel harmless for all damages and consequences arising from such performances.

Decoration / fire protection:

The organiser must observe the hotel's fire safety regulations and, in particular, no escape routes may be obstructed and the smoking ban must be observed in all rooms. The installation of decoration material etc. is only permitted after consultation with the hotel. We would like to point out that all decorative materials brought in by the organiser must be flame-retardant and low-smoking. Only easily removable "poster tape" is permitted for attaching decorative material to walls or ceilings. Written authorisation must be obtained from the hotel in advance for all intended installations/decorations/ rearrangements/redesign work.

Supervision of children:

As there is a pond, a swimming pool and then a stream on the hotel grounds, it is necessary for children to be supervised by an adult for the entire duration of the event and the organiser is responsible for this or must inform the parents of this.

Damage:

All third parties (e.g. witnesses, parents) commissioned by the organiser or third parties attributable to the organiser (e.g. external service providers such as band, wedding planner, photographer or cake suppliers, furthermore also witnesses etc.) for the event must be notified to the hotel at least one week before the start of the event, including their address and contact details. The organiser shall be jointly and severally liable for any damage caused by its guests, employees, agents etc.. In individual cases, the hotel may require the organiser to take out suitable insurance or prohibit the involvement of external service providers or suppliers in the event. The statutory warranty regulations shall apply.
